General terms and conditions of sale
In force since 1 January 2025. Please read them before placing an order.
1. GENERAL PROVISIONS
This document sets out the terms of sale of bimbu SA, Chemin des Oiseaux 11, 1162 Saint-Prex, Switzerland (hereinafter “we”, “our”, “us”).
These Terms of Sale take effect on: 1 January 2025.
These Terms of Sale apply to the sale of products and services on this website. Please read them before placing an order. By ordering on this site, you agree to be bound by these Terms of Sale.
By placing an order on this website, you confirm that you are of legal age and legally capable of entering into a consumer contract.
2. THE ORDERING PROCESS
Your order on this site constitutes an offer to purchase under these Terms of Sale.
After placing an order, you will receive an email from us confirming that we have received your order. This does not mean that your order has been accepted. Orders are subject to our acceptance and to the availability of the products and services ordered.
Descriptions of products and services are accurate at the date of publication, but are subject to availability or change without notice. We cannot be held liable for photographic or typographical errors.
We reserve the right to carry out identity and credit checks to prevent fraud.
We will confirm acceptance of your offer to purchase by sending you an order confirmation (invoice) by email. This will constitute a binding contract between you and bimbu SA.
The contract covers only the products and services for which we have confirmed shipment in the order confirmation. We will not supply any other products or services that may have formed part of your order until shipment of those products or services has been confirmed in a separate order confirmation.
3. PRICE AND PAYMENT
The price of a product corresponds to the respective details shown on the website, unless there is an obvious error. VAT (at the rate currently in force) is included in the prices shown. Delivery costs are not included in the price; these are shown separately next to the offer.
Prices shown on this site may be changed at any time (this does not apply to prices we have confirmed in an order confirmation).
You may make your payment using the payment options available on this site at the time of your purchase, in particular:
• credit cards such as Visa, American Express or Mastercard
• debit cards
• TWINT
• Apple Pay
• Payment by bank transfer
If you pay by credit/debit card, you are subject to validation checks and authorisation by the card issuer. We may share your personal information with such third parties as are necessary to enable us to carry out such checks. If the credit card issuer refuses to authorise payment to us, the order cannot be accepted. We will therefore not be liable for any delay or non-delivery. We will only debit the full payment from your credit/debit card when the products are shipped. We may suspend delivery of the products until full payment has been received. We may terminate the contract between you and us with immediate written notice if you fail to pay on time without valid reason.
We may offer other payment options in cooperation with third party payment providers, such as direct transfer, payment by instalments or payment by invoice. If you choose such options, you agree to be bound by the terms of those third parties as indicated in the ordering process or in these terms of sale, and acknowledge that those third parties process your personal data for payment purposes as described in their privacy notices.
We may offer alternative delivery options in cooperation with third party providers, which are not covered by the default delivery charge. If you choose such an option, the additional cost will be specified during the payment process and in the order confirmation.
It is always possible that, despite our best efforts, some of the products and services listed on our site may be mispriced. We will check prices as part of our shipping procedures so that, where the correct price is lower than the stated price, we charge the lower amount. If the correct price is higher than the price stated on the website, we will generally, at our discretion, contact you for instructions before shipping the product or service, or reject your order and inform you accordingly.
We are not obliged to supply the product or service to you at an incorrect (lower) price if the pricing error is obvious and unmistakable and you could reasonably have recognised it as a pricing error.
4. DELIVERY
We specify the estimated delivery times and delivery charges for the delivery options available during the ordering process and in the order confirmation.
If we are unable to deliver within the scheduled timeframe, we will contact you to propose a new date. If we are unable to deliver within 30 days of our order confirmation and you refuse the delayed delivery, you may then cancel your order for a refund.
We deliver to the delivery address you have provided to us. Any customs duties and taxes specific to the destination country of our shipment will be communicated to you via our logistics provider.
5. TRANSFER OF OWNERSHIP AND RISK
Ownership of the products will pass to you upon receipt of full payment of all sums due in respect of the products (including delivery charges) or upon delivery of the products, whichever is later. We may repossess any product supplied at any time before ownership is transferred if you fail to comply with these terms of sale.
Risk in the products passes to you upon delivery, namely responsibility for damage caused to the products or caused by their use, handling or storage.
6. LIABILITY
Our liability is excluded and limited to the extent permitted by law.
7. GOVERNING LAW AND JURISDICTION
Contracts concluded on this website between you and us are governed by and construed in accordance with Swiss law, without giving effect to its conflict of law rules and regardless of the place of physical performance or execution. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Disputes arising from the conclusion, performance or termination of such contracts shall be settled exclusively by the ordinary courts having jurisdiction in Lausanne, Switzerland, without restriction of any right of appeal. Notwithstanding the foregoing, either party is nevertheless entitled to seek interim orders and injunctive relief before any competent authority worldwide.
8. MISCELLANEOUS
You may not assign any right arising from your contract with bimbu SA to a third party without our prior written authorisation.
The invalidity of any provision of these terms of sale does not affect the validity of the contract between you and bimbu SA.

9. RIGHT OF WITHDRAWAL
You have the right to cancel this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days after the date on which you, or a third party other than the carrier and designated by you, acquired physical possession of the last product.
To exercise your right of withdrawal, you must inform us (bimbu SA, Chemin des Oiseaux 11, 1162 Saint-Prex, email: logistique@bimbu.ch) of your decision to withdraw by means of a clear statement (a letter sent by post or email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.
Only new, unworn products, accompanied by their warranty card and in their original packaging, may be returned. The right of withdrawal does not apply to products which are made to measure or clearly personalised. Nor does the right of withdrawal apply to services which have been fully performed or to the supply of digital content already carried out.
If you terminate this contract, we will reimburse the payments received from you, excluding delivery charges. We may make a deduction from the reimbursement for loss in value of any product supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement within a reasonable time, and no later than 14 days after receipt of any product that you have returned to us. We will make the reimbursement using the same means of payment as you used for the initial transaction. We may withhold reimbursement until we have received the returned products.
You must return the products to us (including any tools, gifts and any other accessories accompanying your purchase) no later than 14 days from the date on which you inform us of your termination of this contract. The deadline is met if you send back the goods before the 14-day period has expired.
You will bear the cost of returning the products within Switzerland.
You are liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products.
