This document describes the terms of sale of bimbu SA, Chemin des Oiseaux 11, 1162 Saint-Prex, Switzerland (hereinafter “we”, “our”, “us”).
The effective date of these Terms of Sale is January 1, 2025.
These Terms of Sale apply to the sale of products and services on this website. Please read them before ordering. By ordering on this site, you agree to be bound by these Terms of Sale.
By placing an order on this website, you confirm that you are of legal age and legally capable of entering into a consumer contract.
Your order on this site constitutes an offer to purchase under these Terms of Sale.
After placing an order, you will receive an email from us confirming that we have received your order. This does not mean that your order has been accepted. Orders are subject to our acceptance and the availability of the products and services ordered.
Product and service descriptions are accurate as of the date of publication but are subject to availability or change without notice. We cannot be held responsible for photographic or typographical errors.
We reserve the right to conduct identity and credit checks to prevent fraud.
We will confirm acceptance of your purchase offer by sending you an order confirmation (invoice) by email. This will constitute a binding contract between you and bimbu SA.
The contract only covers the products and services for which we have confirmed shipment in the order confirmation. We will not provide any other products or services that may have been part of your order until the shipment of these products or services has been confirmed in a separate order confirmation.
The price of a product corresponds to the respective data indicated on the website, except in the case of obvious errors. VAT (currently applicable percentage) is included in the prices indicated. Delivery charges are not included in the price; these are indicated separately next to the offer.
Prices listed on this site are subject to change at any time (not applicable to prices we have confirmed in an order confirmation).
You can make your payment using the payment options available on this site at the time of your purchase, including :
In the case of payment with a credit/debit card, you are subject to validation checks and authorization from the card issuer. We may share your personal information with such third parties as necessary to enable us to conduct such checks. If the credit card issuer refuses to authorize payment, the order cannot be accepted. We will not be responsible for any delay or non-delivery. We will deduct the full payment from your credit/debit card only upon shipment of the products. We may suspend the delivery of products until full payment is received. We may terminate the contract between you and us with immediate written notice if you do not pay on time without a valid reason.
We may offer other payment options in collaboration with third-party payment providers, such as direct transfer, installment payment, or invoice payment. If you choose such options, you agree to be bound by the terms of these third parties as indicated in the order process or in these terms of sale and acknowledge that these third parties process your personal data for payment purposes as described in their privacy notices.
We may offer alternative delivery options in collaboration with third-party providers, which are not covered by the default delivery charges. If you choose such an option, the additional charges will be specified in the payment process and in the order confirmation.
It is always possible that, despite all our efforts, some of the products and services listed on our site may be incorrectly priced. We will check prices as part of our shipping procedures so that, when the correct price is lower than the indicated price, we charge the lower amount. If the correct price is higher than the price indicated on the website, we will contact you, generally at our discretion, for instructions before shipping the product or service, or we will reject your order and inform you.
We are not obliged to provide you with the product or service at an incorrect (lower) price if the pricing error is obvious and unmistakable and you should reasonably have recognized it as a pricing error.
We specify the estimated delivery times and delivery charges for the available delivery options in the order process and in the order confirmation.
If we cannot deliver within the specified times, we will contact you to propose a new date. If we cannot deliver within 30 days of our order confirmation and you refuse the delayed delivery, you may then cancel your order for a refund.
We deliver to the delivery address you provided. You will receive any customs and tax fees specific to the destination country of our shipment through our logistics provider.
Ownership of the products will be transferred to you upon receipt of full payment of all amounts due for the products (including delivery charges) or upon delivery of the products, whichever is later. We may retrieve any product supplied at any time before the transfer of ownership if you do not comply with these terms of sale.
The risk of the products is transferred to you upon delivery, namely the responsibility for damage caused to the products or caused by their use, handling, or storage.
Our liability is excluded and limited to the extent permitted by law.
Contracts concluded on this website between you and us are governed and interpreted in accordance with Swiss law, without giving effect to its conflict of law rules and regardless of the place of its physical execution or performance. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
Disputes arising from the conclusion, performance, or termination of such contracts will be exclusively settled by the competent ordinary courts of Lausanne, Switzerland, without restriction of any right of appeal. Notwithstanding the foregoing, each party is, however, authorized to seek interim orders and injunctive relief before any competent authority worldwide.
You may not assign any rights arising from your contract with bimbu SA to a third party without our prior written consent.
The invalidity of any provision of these terms of sale does not affect the validity of the contract between you and bimbu SA.

You have the right to cancel this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days after the date on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last product. To exercise your right of withdrawal, you must inform us (bimbu SA, Chemin des Oiseaux 11, 1162 Saint-Prex, email: logistique@bimbu.ch) of your decision to withdraw by a clear statement (a letter sent by mail or email).
To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of the right of withdrawal before the withdrawal period has expired.
Only new, unworn products, accompanied by their warranty card and in their original packaging, can be returned. The right of withdrawal does not apply to products that are made to measure or clearly personalized. The right of withdrawal also does not apply to services that have been fully provided and to the delivery of digital content already executed.
If you cancel this contract, we will reimburse the payments received from you, excluding delivery charges. We may make a deduction from the reimbursement for the loss of value of any supplied product if the loss is the result of unnecessary handling by you.
We will make the reimbursement within a reasonable time, and no later than 14 days after receiving any product you have returned to us. We will make the reimbursement using the same means of payment that you used for the initial transaction. We may withhold reimbursement until we have received the returned products.
You must return the products (including tools, gifts, and any other accessories that accompany your purchase) to us no later than 14 days from the date you communicate your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.
You will bear the cost of returning the products in Switzerland.
You are responsible for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the products.
